THE VIOLATIONS

"USSTC violated section III(c)(1)(c) of the STMSA by using its Skoal Brand Name to sponsor NHRA National Events and NHRA Sports Compact Events in which some drivers were younger than age 18."

Drivers under the age of 18 have competed at some National Events and some Sport Compact Drag Racing Series events. Jr. Drag Racing League members ages 8-17 competed on the same racetracks as some National Events and Sport Compact Events. The Skoal signs remained on the racetrack during the Jr. Drag races and Jr. Drag racers where shown on the big screen video display, which was bordered by a large Skoal sign.

"USSTC violated section V.C of the Consent Decree and section III(c) of the STMSA by making or causing to be made payments to NHRA and Don Prudhomme Racing, Inc. to use, display, and make reference to items, such as vehicles, signs, and clothes bearing the Skoal Brand Name, in Media, such as live NHRA events, television broadcasts of NHRA events, and Internet broadcasts of NHRA events in connection with its NHRA-related sponsorships."

"USSTC violated section V.D. of the Consent Decree and section III(f) of the STMSA by marketing, distributing, offering, selling, licensing, or causing to be marketed, distributed, offered, sold or licensed apparel and other merchandise bearing the Skoal Brand Name in connection with its NHRA-related sponsorships."

"USSTC violated section III(d) of the STMSA, in connection with its NHRA-related sponsorhips, by using or causing to be used the Skoal Brand Name on signs, vehicles, and other Outdoor Advertising at NHRA events."

USSTC violated section III(c)(2)(A) of the STMSA by sponsoring in 2004: the NHRA POWERade Drag Racing Series; the NHRA Skoal Showdown; the NHRA Sport Compact Drag Racing Series; two NHRA Funny Cars; and one NHRA Top Fuel dragster. These sponsorships constituted more than one Brand Name Sponsorship in the States in the twelve-month period of calendar year 2004.

USSTC violated section III(c)(2)(A) of the STMSA by sponsoring in 2005: the NHRA POWERade Drag Racing Series; the NHRA Skoal Showdown; the NHRA Sport Compact Drag Racing Series; one NHRA Funny Cars; and one NHRA Top Fuel dragster. These sponsorships constituted more than one Brand Name Sponsorship in the States in the twelve-month period of calendar year 2005.
